DMCA & Copyright Policy

Adwave Inc. (“Adwave,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects users of the Wavemaker platform (“Service”) to do the same. We comply with the Digital Millennium Copyright Act (“DMCA”) and respond to valid notices of alleged copyright infringement.

How Wavemaker Works

Wavemaker is an AI video generation platform that orchestrates third-party AI services (including image generation, video generation, voice synthesis, music generation, and language models) to produce video content on behalf of users. Adwave does not develop, train, or operate its own AI models. All AI-generated content is produced by third-party services based on user-provided prompts and inputs.

If you believe that content available through the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent. Your notice must include the following:

  1. Identification of the copyrighted work you claim has been infringed, or a representative list if multiple works are covered by a single notice.

  2. Identification of the infringing material and information sufficient for us to locate it on the Service (such as the gallery URL, session ID, or video title).

  3. Your contact information, including your full legal name, mailing address, telephone number, and email address.

  4. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  5. A statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

  6. Your physical or electronic signature (or the signature of a person authorized to act on behalf of the copyright owner).

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability.

What Happens After a Notice

Upon receiving a valid DMCA takedown notice, we will:

  1. Remove or disable access to the allegedly infringing material promptly
  2. Notify the user who posted the material (if identifiable) that it has been removed
  3. Provide the user with information about how to submit a counter-notification

Counter-Notification

If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our designated agent. Your counter-notification must include:

  1. Identification of the material that was removed and the location where it appeared before removal.

  2. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.

  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your judicial district (or any judicial district in which Adwave may be found if you are outside the United States), and that you will accept service of process from the person who submitted the original takedown notice.

  4. Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant and restore the material within 10 to 14 business days unless the complainant files a court action.

Repeat Infringer Policy

We will terminate the accounts of users who are determined to be repeat infringers in appropriate circumstances. We consider the totality of the circumstances in making such determinations.

Wavemaker orchestrates third-party AI services to generate content. The AI models used are developed and operated by third parties. Adwave does not control the training data, weights, or specific outputs of these models.

If you believe that AI-generated content produced through our Service infringes your copyright:

  • For content currently hosted on Wavemaker (e.g., in the public gallery), submit a DMCA notice as described above and we will remove it.
  • For concerns about the underlying AI models that generated the content, we recommend contacting the relevant AI model provider directly, as they control the model training and output patterns.

Users of the Service are solely responsible for reviewing AI-generated content for potential copyright issues before publishing or distributing it. See our Terms of Service for more details on user responsibilities.

Limitations

This DMCA policy applies to content hosted on or accessible through the Wavemaker platform. Once a user exports and downloads content from our Service, we have no control over how that content is used or distributed.
